Sex Designation-Notes : ​Maine is similar to Oregon. Starting in July of 2020 Maine added the option of assigning the gender marker option of “X” on the birth certificate at the time of birth. Maine now has two fields on the birth certificate. The sex field can be filled in with male, female, x, or unknown. The sex (biological) field is filled in as male or female. The biological sex field is used when records are sent to NCHS or other agencies that do not allow for non-binary gender.
Correction:
Apologies, all – my colleague Shannon Gifford explained to me that I didn’t quite have the correct understanding of Maine’s approach. The birth certificate, as she noted in her email message, has just one field, with the option of assigning the gender marker option of “X” at the time of birth. (from Sarah Wilcox) - There is also a field for sex (biological) on the medical worksheet only, which we use internally for reporting to other agencies such as NCHS that only allow for binary gender. This allows a work around for using binary gender when necessary to share population-level data, while providing an option for non-binary gender on personal identity documents
