That being said, we've adopted a policy/practice of 'suppressing' the sex field and the character marker for birth applications (certifications) when a registrant either desires a change and does NOT have the necessary legal documentation or standing to have an amendment made to their document, or the registrant has a desire for a non-binary character.
We've found that this process is acceptable for the registrant (personally), and the driver's services and the passport agency have accepted our documents. This process preserves the intent and integrity of the file and record, and seems to be acceptable to the requesting party
